Legal Question in Construction Law in Pennsylvania

New home Construction - Leaking/Water damage

I purchased a brand new construction home on 5/13/06. On the first big rain storm after my wife and I moved in, we had a leak in the 2nd floor ceiling. The contractor came back a few times and each attempt to fix the problem has not worked. We still have the problem today, and now 2 years of water damage, including bugs that are associated with wood moisture. The Contractor now says we are outside of the warranty on the house and will have to pay for repairs out of pocket. Do I have any legal recourse? Should I obtain a Lawyer?

You absolutley need to see a lawyer. New home construction is subject to implied warranties as well as any express warranty you were given. You have rights but may lose them if you do not act promptly.
