Legal Question in Consumer Law in Pennsylvania

90 day bumper to bumper warranty

bought a 2001 Lincoln LS with 90 day, 3000 miles bumper to bumper warranty. Since July 10, Catalytic Converter, wind shield wipers, horn, light in trunk fixed. Monday the airbag on passenger's side fixed. They told me the car used Regular gas getting 26 MPG. After the good gas was gone, the car gets 12/13 MPG. By now I read the book which said must use Premium gas. I have taken it back about the transmission feeling like it is slipping and the brakes feel soft not firm. They said it's how I drive. Haver been driving 45 years.

What should I do as I have 100 Miles left before the 3000 Miles.

Thank you

Re: 90 day bumper to bumper warranty

Assuming you are still within the 90-days and 3000 miles, and assuming the defects are the types of defects that are covered by the warranty, you might

write them a letter documenting exactly what is wrong with the car and that you have asked them to repair it under the warranty and they have refused. In the letter, request that they confirm that they will immediately repair these items, and state that if they do not, you will be forced to file suit in small claims court to recover the damages or to seek rescission (reversal) of the purchase transaction. Assuming you have sufficient tuime left under the warranty, give them seven days to respond. Also mention in your letter that other things went wrong with the car that have been fixed, and the whole pattern suggests that they knew that the car was defective when they sold it to you, but failed to disclose the defects. If they do not agree to give you the requested relief, sue them in small claims court (unless the contract contains an arbitration clause, in which case initiate an arbitration). Good luck.
