Legal Question in Consumer Law in Pennsylvania

Battle over a Car

I used to take care of a elderly couple. Drive them all over they were unable to drive. They gave me their car. The husband passed away. Now the kids of the wife want me to return the car to her. It has been over a year since the car was givin to me. Now I get a call that she wants the car back. It was a gift to me from them. She went with me and signed the car over to me. And the kids knew about this when it took place.

Re: Battle over a Car

If the car is now titled in your name, you should prevail. The law of gifts provides that there must be donative intent followed by delivery of the item. You clearly have delivery of the item as you have possession, the keys and title all given to you by the donor. The only question is one of their intent to make a gift. Do you have any witness outside the family who heard either party say they wanted you to have the car? If so, you should have no trouble. Proving thay you drove them around and did their errands chould also help your case.
