Legal Question in Consumer Law in Pennsylvania

Breech of contract?

My videographer's contract states that I can buy my original tapes as long as the request is made within 2 months of delivery of the master edited tape. I made the request within the 2 months, and now they are telling me that I can't buy them because they own the copyright. What legal rights do I have?

Re: Breech of contract?

It depends on the wording of the contract, of course, but in general it looks like they are not honoring the terms of their agreement based on the facts that you have given. More than that, unless there is language in that agreement where you signed over the publicity rights to them, they will not be able to broadcast the work (show it to clients, etc). Could it be that they lost the originals? Something doesn't sound right here. They have everything to gain by selling you the tapes if they have them. Further consultation with a lawyer will let you know the full extent of your rights.
