Hardwood floors refinished

I hired a company that refinishes hardwood floors to do my living/ diningroom. In my living room, theres an approx 3 ft section of the floor where u can see that the previous owners had replaced the wood. When this current company sanded down my floors, it was all the same color. When I asked him to stain the entire 2 rooms, he gave me a price that I didn't want to pay, so I told him just polyeury- thene it. But when he put the poly on it, the 3 ft section came up a totally different color. 99% of the floor is a Brazilian cherry color; the 3 ft section is a light blond gold color. I didn't stop him at the time bcuz he had already put the poly on it, & I didn't think there was anything I could do about it. I shelled out $1,400.00 for this. After thinking it over for week or so, I called him back to see if he would come back & stain the 1 section the same color (or as close as possible) and I would pay for the stain and the poly. He wants to charge me another $200-300.00 for that. I don't think I should have to pay that amount for a 3 ft section. He knows woods & how they react to stain, I don't. I thought he s/h told me b-4 he poly'd what the floor would look like (it's 2 diff woods). Do I have a chance to win if I sue?
