Spousal joint assets are protected from a collector unless the collector obtains a judgment against both spouses. Obtaining a judgment against both spouses in a credit card case would be highly unusual.
Your husband should have a consumer attorney, whether its myself or someone else, review the credit card lawsuit. Many collectors can be easily beaten by a knowledgeable consumer attorney.
