Legal Question in Consumer Law in Pennsylvania
Lead Paint Liability
If an American company sells a product that is painted with lead based paint, and the product was made in china, who is liable? Also, the product is not marked in any way to indicate the presence of lead based paint. Does the answer change if the American company denies knowledge of the lead paint's presence in their product?

Re: Lead Paint Liability
Everyone in the chain, from the manufacturer to the seller can be liable. Their lack of knowledge is a defense that may reduce liability, but not a bar to suit.
