Parking Garage Auto Damage

Auto parked in multi floor self parking garage in Philadelphia, PA. Someone attempted to break into coveratable top, BMW 325ci car. Tearing cloth top causing $3,605 in damages to the top. Parking garage says they are not liable for damages. My insurance company will pay but I have a $1,000 deductable and my rates will go up. I want the garage to pay in full. If they do not I want my insurance company to subrgate against garage to recoup the loss. Is the garage liable? They said since I had the keys they were not have care custody and control of the car so they are not liable.

You can pursue a civil claim agains the parking garage but it will probably cost you more than either your deductable or the actual damage to your vehicle...besides your case would not be a slam dunk...on your ticket they probably limited their liability by placing you on notice that the parking garage is not responsible for any damage(s) caused to your vehicle.
