Legal Question in Consumer Law in Pennsylvania
Recorded telephone conversation without the knowledge of both parties. Recorded secretly by one party. One in New York State the recorder & one in Pennsylvania with no knowledge of the recording.
1 Answer from Attorneys
You do not tell me which person was doing the recording and where they were located. I also assume that at least one party to the conversation consented to the recording.
New York is a one party state which means that at least one party to the conversation must consent. The NY wiretap laws are codified at Article 250 of the NY Penal Law.
