Refund on DJ services not received

My daughter has paid a DJ - $700 to entertain at her wedding reception - April 22, 2006 - it is 2 weeks before the wedding and she can not contact her DJ - she had spoken with him on the phone previously and actually retained him online - now his phone number has a message stating that it does not take incoming calls and all of her attempts at contact have been ignored - she was able to get another DJ at this late date (thankfully) but, how should she proceed to get her $700 back - we do have a current buisness address -the actual address is in Ohio.

She really needs some advice - she can not afford to lose $700 over this - what should she do ?

She should contact an attorney to pursue a civil and even a possible criminal fraud case, the only problem here is, if the alleged defendant does show up at the wedding to perform his contractual duties her case becomes problematic.

My recommendation, retain counsel now, have them draft a letter to his last known address spelling out the reasons why your daughter has hired someone else, why she is cancelled her contract with the original DJ and that demand a refund.

She should send a registered letter (Priority Mail) to the DJ cancelling the contract and demanding return of the payment because she was unable to confirm his performance. She should inform the DJ that his services are no longer needed as she has obtained a replacement due to his unavailability.

After the wedding she can file suit in small claims court to recover the money. Make sure that all the instructions available through the court. The forms and instructions are available online. Be certain to name the exact party with whom she contracted. Service must also be made on the proper party, again, following the instructions available.
