sold baby birds to pet store and he never paid for them

A friend works in a pet store and asked me if they could take some baby birds to the store and sell them and pay me when the birds sold. I agreed. the birds all sold within a month and the last payment I got was in march 2004. the store still owes me 4000.00 and I can't collect it.

I have trusted people to take birds and make payments. just about everyone that I have trusted will not pay me. what can I do?

You will have to file suit to collect. The size of the claim allows you to porceed at the district justice level. I offer free consultations.

Two things. First, stop taking payments. In the future, the deal should be cash up front. If you find that you have to take payments, make sure that you get an attorney to write out a contract for you making it clear what you are giving them, what they are paying you, and when.

What's going to happen here is that they will argue that 1) they don't owe you anything; 2) that if they owe you something, it is much less than you say it is, and 3) that you can't prove otherwise.

You can file suit at the district justice level. If you lose there, you can appeal.

Long term advice, get a lawyer to help you with these deals.

As long as you were allowed by law to sell the birds, ie - not banned due to either federal or state law, you would need to file suit in order to clarify this matter...this more then likely would be at the District Justice level,

The best advice I can give you is to consult with an attorney and have them draft you a contract next time.
