Legal Question in Credit and Debt Law in Pennsylvania

Arbitration awards on both sides

We obtained an arbitration award against MBNA. We recvd the award by writing a series of letters

(debt dispute, notice of final pmt, arb rejection letter, demand for arb, etc.)which cited various cases and literature against credit cards...

MBNA eventually took us to arb using the CA Wolpoff & Abramson, and won thru the NAF. We did send a lengthly arbitration rejection letter to the NAF, but of course W & A always wins w/ them. Their only evidence against us was a computer generated print-out and a portion of a cc applic w/ the arbitration clause, no signature.

Are we safe bet from judgement? It seems like a battle of arbitration awards may be on the horizon. We got our arbitration on record first at the cthouse but did not have it confirm confirmed. Thanks.

Re: Arbitration awards on both sides

It is difficult to accurately answer your question. I suggest you consult legal counsel to make a determination of which award takes precedence. It does not sound like you had obtained a valid arbitration award first. It is possible I did not understand your comments. The agreement for arbitration and the facts must be reviewed before any accurate determination can be made. Gerald Hershenson Esq.215-579-9390
