Legal Question in Credit and Debt Law in Pennsylvania

auto repo

car was repoed 1 year ago. they haven't sold car, but are now claiming i still owe them$20,000. can they attach my wages???? the vehicle at one point was in chapter 13, but i sold a home and told creditor that i would pay off the car. needless to say no attorney would give me the time of day.so i gave the vehicle back. now like i said they want me to pay for something i don't own, and are threatning to attach my wages. can they do that?????

A creditor who repossesses a car has the legal right to sell it and sue you for the deficiency. An interesting question is raised as to whether they can pursue you for the balance, without selling it. I have never seen that happen and it is probably prohibited by the law which allows the action, the Uniform Commercial Code.

However, at some point, they will be able to pursue some balance. I suggest you consider your options at dealing with this debt.
