Can a collection attorneyfile criminal charges for a post dated check that was returned due to nsf?

Anyone in the Commonwealth can file a private criminal complaint. The district attorney reviews the filing and determines whether or not formal charges should be filed. In the situation you describe it is unclear if any law was broken. I offer free consultations.
