whats next?

i had a bill i could not pay it went to a collection agency, i tried to make a payment they said nothing but the full payment, i couldn't do that, they said it's a refusal to pay and further action will be taken. what's next?

They can continue to try to collect, by making phone calls to you on a regular basis, or they can sue you.

You may have recourse against them if they violate the law by making harassing calls to you, call you too early or too late in the day, are abusive in their calls, etc. Make notes of all calls and what is said, and who you are talking to.

If the debt is over 4 years old, it may be outside the statute of limitations. Do not admit that you owe the money.

If they do file suit against you, don't ignore it. Many, many times those being sued have valid defenses to the suits, including, but not limited to, the fact that collection agencies often do not follow the law or the rules of court in filing their suits, and, if challenged, judges will toss them out.

In any case, you should hire an attorney immediately if you are sued.

You could also hire an attorney to attempt to negotiate with the collection agency if that's what you would prefer.

I agree with the previous post for the most part. They will sue you, and you need to defend the case. Collection Agencies have a VERY difficult time proving a case against you if you have a knowledgeable consumer attorney on your side. I would not negotiate with them, unless and until you have a consumer attorney review the case to see if they can prove everything that they need to.
