Legal Question in Credit and Debt Law in Pennsylvania
I borrowed someones credit card, they say I didn't pay- now they're suing me...
Someone lent me their credit card, in turn, I allowed another of our mutual friends to use it- I paid my share the other fellow didn't- the actual cardholder holds me totally responsible and is suing me for thousands of dollars of interest and penalties. It was her credit card, even if I charged it up and never paid- isn't it her responsibility to pay? Can she win her suit against me for Unjust Enrichment and Promissory Estoppel ? If she gets a judgement against me...is that good for anything anyway? What should my defense be ? She also added my name to the account without my permission- I never legally agreed to pay the credit card company. I paid her my share of charges- she denies that. She is suing me for $3519.00 in compensatory damages. What should I do? I can't afford an attorney like she has. Thanks for your help.

You are responsible for the credit card charges unless the person you gave the card to was authorized to make charges by the owner of the card. I suggest you sue and join as a party the person who made the charges. If you can not afford an attorney, I suggest you contact Legal Aid. Gerald Hershenson 215-579-9390

Since the person who gave you the card entrusted you with it, and didn't authorize the other person to make charges, you are responsible for the charges of the other person. You should in turn sue the other person or preferably join them in this suit. You need an attorney.
