How can I break a timeshare contract? Diamond Resorts (formerly Sunterrra) has not fullfilled their part of the agreemment.

This is really a real estate question. There is no way to "break" a contract. What state is the timeshare contract in? That state's law will govern. First, read the contract. Are you still within the cancellation period? If so, then follow the instructions to cancel.
It is very unlikely that they will just release you from further obligation, but it will depend on how they have broken the contract. In what way are they breaking the contract?
If you cannot get them to release you, perhaps you can get them to at least comply. Failing that, the only way to get rid of a timeshare is: (1) donating it or giving it away (if it is paid for); or (2) selling it.
If you decide to sell, do not go to one of the ripoff companies that will charge you $700 or more. They do not work. Get advice first from http://www.tug2.net (TUG stands for Timeshare Users Group). If your timeshere is paid off and you want to donate it and at lest get a tax deduction for it, try: http://www.donateforacause.org.
I have assisted several individuals in getting released from their timeshare agreements because of their circumstances, but it depends on the timeshare group. I have never dealt with Sunterra/Diamond Resorts before and cannot guarantee your release.
