Legal Question in Credit and Debt Law in Pennsylvania

My brother is getting sued by a company, and his court date is on the 15th of July. The problem is he got a paper stating that the court case was dismissed and has written agreement that he is to pay the 5th of every month. He brought the paper to the court house and they told him that the company never sent him anything. So he called the company and they told him yes the issue was resolved BUT he STILL has to appear in court and pay the total due before the 5th of July. Nobody from the company will be at the court case and my brother will not be able to defend himself. What can he do? Does he still have to appear in court?

I cannot discuss your brother's issue with you for ethical reasons. You don't tell me what kind of case this is (civil or criminal) or what state (I am only licensed in GA, PA & NC). I don't why your brother was ordered to pay if the case was dismissed, so something does not sound right.

I suggest that your brother contact an attorney but the kind of attorney will depend on what kind of payment he was ordered to make. This sounds like it might be criminal, like for a bad check, but I cannot tell without review of the paper.

And if your brother is being sued civilly by a company, they are required to have a lawyer. Don't they have one? Your brother might want to contact their attorney to find out why the case was dismissed. If this is a civil case, it might be that the case as not dismissed, but that a judgment was entered and your brother ws given until July 15th to pay. Again, review of the paper would clear this up.
