Civil Action

I fell behind on payments with Citifinancial. Sent them a payment on 9-29. 10-1 received a letter giving me 15 days to catch up, 10-2 they filed a civil action against me, can they legally do that

Yes. You should defend, though, especially if it's at the Magistrate level.
