i just got a civil complaint from capital one bank is it possible to start a repayment plan with them. and who would i have to call

Yes. You call the the lawyer for Capital One. Get this in writing before you send a penny. It would be better if you saved money to do a settlement rather than a payment plan, but it depends on your circumstances and whether you have a lot of assets that can be seized.
