civil suit

being sued by collector for old debt that was supposedly dismissed due to negligence on on creditors part they said they fired the man that threatened me and reimbursed the monies they over drafted my account for posting a postdated check early how do i respond to this suit it isn't by original creditor

There may be many defenses to this claim. You should hire an attorney familiar with collections law.

You must defend the suit. I suggest you consult with an attorney. Have all the documentation regarding the settlement with you. If the debtor agreed to release you from the debt under the terms you describe there has been an "accord and satisfaction". In that event you are not responsible for the debt. However, you must defend any legal action or your rights will be jeapodized. You must plead the release as a defense. Gerald Hershenson Esq.
