Legal Question in Credit and Debt Law in Pennsylvania

How to collect judgment?

I received a judgment from small claims court. Do I have to enroll that anywhere? Now that I have the judgment, what do I do next? Am I entitled to pursue monies in the debtor's checking account? Do I need a ''writ of execution''? If so, what is that? Thank you for any help you can provide.

Re: How to collect judgment?

At the District Justice level you may file a request for execution on personal property of the debtor after thirty days from the date the judgment was entered. However, you can not levy on a bank account at the distict justice level. You must obtain a certified copy of the judgment and record it in the county in which you desire to make the levy. You may request a writ of execution and attach bank accounts at this level. However, the process is so complicated that it can not be explained in this forum. I suggest you hire legal counsel to assist. If I can be of any help, let me know. Gerald Hershenson 215-579-9390
