Legal Question in Credit and Debt Law in Pennsylvania

collection agency

I have defaulted on a credit card. A collection agency has got a judgement against me and soon they are going to file with the sheriff to sell my personal property. I understand that credit cards are unsecured. Is this legal? Can I get this judgement dropped?

Re: collection agency

Generally it is possible for a credit card company to secure a judgment and then have a sheriff sell your personal property.

If the judgment was obtained without complying with all the formalities or sometimes for other reasons you may get it opened.

Depending on how much is at stake you may want to consult with an attorney that has an office near you.

Good luck.

Re: collection agency

Credit cards are unsecured but they may still collect on credit cards. Unsecured just means that the creditor is not holding collateral. Are you sure the collection agency has a judgment? Usually a collection agency doesn't have standing in court to file a complaint.
