Legal Question in Credit and Debt Law in Pennsylvania
collection of debt from deceased
My father-in-law passed away and my wife keeps receiving small hospital bills after insurance has adjusted them. She was his POA and he was a widow. Is she resposible for paying these debts or do they cease when he died?

Your wife is not responsible unless she specificly promised to pay. The debt would have to paid out of the assets of the decedent. I suggest you consult an attorney to write a letter on your behalf informing the creditors of the death. A fee for such a letter would be minimal. The attorney could review the situation to determine if there were any factors present that would impose liability upon your wife. Gerald Hershenson Esq. 215-579-9390

The debts should be paid from the estate of your father-in-law. Your wife wouldn't have responsibility unless she specifically indicated that she would be responsible.
