Collection Problems
A little over 7 months ago I decided that I wanted to try to amke some extra money selling items where other than on ebay. It was going good for awhile except I made one BIG mistake. I had started doing this with a partner the problem was that I was the one doing all the work, spending all the money for shipping costs, buying the items to sell etc. To make this short the guy took advantage of what I had helped him with and I quit working with him after he had access to my bank account with out permission and changed my passwrods and all on my ebay account so I couldnt even get in. I had a written aggrement notorized stating that he had 120 days to pay me 4,000.00 that was used of my money to start and money I had to pay for expenses he slipped up on. His 120 days are up now by 2 weeks and he refuses to make an attempt to pay stating its been rough and he doesnt have money etc again. Im really not sure what else I can do to recieve my money even an attempt of some of the money. I dont know if its possible to have a Sheriff's sale with what I have, or if theres anything I can do. Please any advice at this time would help.

You have to obtain a judgment to have a Sheriff's Sale and it sounds to me like you may be throwing the costs away if you pursue this as the guy doesn't have any money. However, part of your question indicates he accessed you bank account without permission. If that's the case you may want to talk to an Assistant D.A. about the matter in your local Magisterial District.

It sounds like you have a good story. You could pursue breach of contract in small claims court or hire an attorney to help you.
