Legal Question in Credit and Debt Law in Pennsylvania

Collections

I am being threatened by a collections law office for money I owed to Household Finance, This was around 2000 or 2001. I live with parents and have no license or no means of income. Is there a statue of limitations for these collections and what can I do? they constantly threaten.

There is a statute of limitations for contract actions in Pennsylvania. They must be brought within 4 years. They can file suit against you, and attach your wages. If you have any questions, you can e-mail me directly at [email protected].

I have to disagree with the other answer in part. The statute of limitations is four years however, if it is a typical contract dispute, they cannot attach wages. The statute is at 42 Pa.C.S. section 8127 and provides in part:

"� 8127. Personal earnings exempt from process

(a) GENERAL RULE AND EXCEPTIONS.-- The wages, salaries and commissions of individuals shall while in the hands of the employer be exempt from any attachment, execution or other process except upon an action or proceeding:

(1) Under 23 Pa.C.S. Pt. IV (relating to divorce).

(2) For support.

(3) For board for four weeks or less.

(3.1) For amounts awarded to a judgment creditor- landlord arising out

of a residential lease upon which the court has rendered judgment which is final.
