Contractor fails to pay subcontractor

My fiance recently performed services for a contractor (with a signed contract). The ''punch list'' generated from the job contained items that were not part of the original contract. The contractor is refusing to pay based on the fact that ''all'' items on the punch list were not completed, even though they were not part of the orignal contract. How should my fiance pursue collecting payment for the services agreed to in the contract?

If the amount due is less than $8,000 a law suit in small claims court would suffice. There is a right of appeal. However, I suggest you consult with an attorney to be assured that the procedure you use is most effective. If the claim is over $8,000 a law suit has to be instituted to enforce payment.
