Legal Question in Credit and Debt Law in Pennsylvania

I am a co-signer on a student loan. The loan is in collection. The collection agency is giving me the chance to pay a portion of the loan to clear my name of the loan. Should I do this? Can I sue the borrower for restitution?

Be very careful in paying a collection agency anything. This could be a ruse simply to get you to acknowledge the debt and/or to disclose where you bank or have assets. You need to have a consumer attorney review the documents and to review the fact situation in a little more detail. The attorney will want to know several things, who is the collection agency, when was the date of default, where is the contract, when was the last payment, to whom was the last payment made, did the collection agency purchase the delinquent account, or are they acting for the original creditor... I could go on and on. Consult a consumer attorney.
