Credit Agency refuses to update Credit Report...Help!

I have an item on my credit report that was charged off in 3/97. I requested that the credit agency remove the item for the following reasons: 1) The actual delinquency and charge off are both more than 7 years old. According to the FCRA, etc.,1) no item should exist over 7 years...section 605(a)(4) and 605(a)(5). This item was placed prior to the enactment of the Consumer Credit Reporting Reform Act of 1996 and therefore is not affected by the new rules...section 605(c)(1). 2)The report notes that a payment was made in 3/97 (that was the charge off) and consumer activity in 9/97. This is inaccurate. I have written to the reporting agency several times to remove this item but they are refusing to do so. What further actions can I take to rectify this situation? Is there someone/place that I can report the credit agency to? Please advise......thanks!

You're saying the item was placed prior to the Act of 1996 but you indicate that they posted in 97?

Also, as you are probably aware, when you dispute an item, the agency has 30 days to either verify or remove the item. From what you're saying, they have done neither?

You could sue the credit bureau for violation of FCRA. Money damages of $1000 per violation are available.
