Can a credit card company sue you in court for a balance on a credit card from over 5 years ago? I have a credit card that has a balance that I had long forgotten about and have not been paying on. I only work 16 hours a week, I have 2 small children, and am not married to the man I live with. I bring home about $140 a week and cannot afford to repay this debt. What, legally, can this collection company do? Obviously the original crditor charged off this account so the money will not go back to them.

The collection company can file an action against you. You would have to defend and assert that the suit is barred by the applicable statute of limitations which is four years.
