Credit Card Debt

I lost a case with Capital One last year (It is credit card debt I owe from five years ago when I lost my job) - Offered to pay them $100 dollars a month, but they laughed and said I would need to pay them at least $700 a month. I am a full-time student and work only part-time. I can not file for bankruptcy, because I will be unable to get my student loans if I do - I plan on filing for it when I am almost ready to graduate, to get rid of the $40,000 of old credit card debt I owe. They just seized my bank account and left me with nothing, the credit card debt was unsecured, and I offered to make them payments, so now what do I do. I will be homeless living under a bridge to make them happy - I have tried for two days to talk to the lawyer at their firm but no reply from him yet.

Once they have obtained a judgment there isn't a lot that you can do other than file for bankruptcy. Did you assert the Statute of Limitations? If you quit paying on the card over 5 years ago, then the suit should have been barred by the SOL.
