Legal Question in Credit and Debt Law in Pennsylvania
Credit card debt
I had a credit card in my name only, we ran into financial trouble few years ago and defaulted. When we were able to refinance last year I called the colletion company and they sent it back to the Credit Card Co. When I called them, they said there was nothing I could do. A few months ago we started getting calls from a 2nd agency wanting to collect. We were going to settle when I found out I had serious medical problems and am now disabled. I will receive SS Disability in a few months. I tried to work this out with the agency and the man was extermly rude, threatening to take our house and car away, calling us names. Last week they filed a civil suit against him.
We don't know what to do now. We barely have enough to pay our mortgage and utilities. I won't get SS payments until August. I called one lawyer and she told us to file for backruptsy but we would rather not and if something happens to my husband and I need to get a loan, my credit will also be ruined.
Any advise would be appreciated.

Re: Credit card debt
You indicated that the person from the collection agency made threatening comments to you and called you names. This could be a violation of fair credit collection laws. If so, you could have an action against the collection agency.
