Legal Question in Credit and Debt Law in Pennsylvania

credit card debt sheriff sale

Can a Sheriff enter your home for credit card debt judgment and have a sheriff sale? Can they take an auto from a disabled person? A debt collector letter stated they would have a sale if we did not pay up.. I thought for CC debt they could just put a lein on your property if there was a judgment? What if other people live (daughter/husband) in the house and pay you rent, how can they prove that real or personal items belong to who?

Any advice would help, what should I do to protect my self?

Thank you

Re: credit card debt sheriff sale

This appears to be the same question that you asked about an hour ago, if you are the same person. They can execute any way that is legal on a credit card judgment. See, there really is no such thing as a credit card judgment, its simply a judgment, period. The can levy on personal property, garnishm a bank account, place a lien on real property. The CC company does not have to prove that you own something, it will be up to you, or the real owner, to disprove it once the sheriff places the levy. Regarding your final question, attorneys really cannot give advice to help you hide assets, if that is what you are asking.
