Legal Question in Credit and Debt Law in Pennsylvania

Please Help - Credit Card Debt - 5 years after

In November of 1999 I ran into financial problems and paid almost all my creditors except one. The credit card company that I failed to pay sold my debt to a collections agency and now after almost 5 years they are calling me and threatening to sue me if I don't pay what I owe. What should I do, pay the bill or use the statute of limitations defense since I believe it's 4 years for credit card debit in Pennsylvania. My credit is bad as it is.

Let the collection agency know you dispute the debt as the statute of limtations has expired. Then inform them that if the debt is not removed from your credit record that you may persue all legal means to force them to remove it.

I agree with what Atty. Johns said with this caveat. The statute of limitations is four years, but it starts over if you acknowledge the debt. In other words, if they called you and you said, "yeah, that's my debt..." the four years starts over.

Provided that you didn't do that, I agree with the advice given to you by Atty. Johns.
