Credit Card judgment - Sheriff Sale
A law firm sent me a letter stating that if I did not pay my judgment of $2800 within 10 days they will do a sheriff sale. Can a sheriff come into my home in the state of PA and take real or personal property for credit card debt? Can they take an auto of a disabled person? Also spouse currently laid off from work.... What if I were to send monthly payments of $10 - $20 and if cashed can they further try to go after me? Please advise. Thanks, Donna

A sheriff can place a levy on your personal property and expose it to public sale. You mention that you are married. Once the levy takes place, your spouse can file for a sheriff's hearing, the cost should be relatively inexpensive, and the spouse can make the argument that you two own most things jointly. The CC company cannot execute on things jointly owned between husband and wife unless their judgment is against both spouses, and most times it is not.
To answer your other question, they will not and do not have to accept $10 payments. It is not up to you to determine how much they will take. They can do anything within the law to recover everything that is owed to them, and they can do all of those things right now.
