Legal Question in Credit and Debt Law in Pennsylvania

credit card served notice

that they are sueing us... What do

we do? We filed Chapter 7 in 1998

and everything was discharged. Are

we eligible to file Chapter 13? If we

go to court by ourselves what do we

need to know? Can we do this? I

understand if we do not appear it

would look worse.

If the debt was incurred prior to your last case, it was discharged. If it was incurred after, it was not.

You cannot receive a Chapter 7 discharge if you have filed within the last 8 years. Your 1998 bankruptcy was clearly before that and you may be eligible to file another one.
