Legal Question in Credit and Debt Law in Pennsylvania

Can a credit union sue because of non payment of an unsecured loan and an inability to. Pay off a credit card. I have a small social security check and a city pension.

Yes, of course they can. Why would you think otherwise? Inability to pay is not a legal defense.

I agree with Attorney Artim. This is a stupid question. The question is never whether you can be sued but whether a judgment if entered on the debt can be enforced. In your case, the answer to the question of whether a judgment can be enforced is it depends.

Credit union debts are very very hard to resolve. Some of the credit unions whom my clients owe money to want 50% to 100% of the debt owed. Fortunately in your case Social Security and pension cannot be garnished for something like a credit union unsecured loan. However, know that there is no exemption to a judgment in PA for land or for motor vehicles or for furniture/household goods. You do not indicate what assets you have other than Social Security and pension or whether you are married and the answer to whether a judgment can be enforced is going to depend on your circumstances. I suggest that you consult with an attorney before a lawsuit arrives and start building up a war chest to resolve the debt at some point so you will be able to resolve the debt if and when a lawsuit comes.
