how often can a creditor call in 1 day after speaking to you, and you explaining to them your situation and telling you they will mark the account that you called

They can call as often as they want. However, under the Fair Debt Collection Practices Act as well as Pennslyvania state law, you have a right not to be harassed. So if they are calling outside the hours of 8 am to 9 pm, or causing the phone to ring so much that it is harassment, then there is a problem.

Stop talking to them. They don't care about your situation or why you have not paid. They only know that you have not paid and they want to hear how you are going to pay. So don't waste your time.

Within 5 business days after making phone contact, they have to send you a letter. You write to them and ask for what is called validation of the debt to prove that you are legally responsible for this debt. While they are obtaining validation, they cannot call you. Also in your letter to them, you can ask them not to call your employer (and this is important) because your "employer does not allow you to receive personal calls at work." Use these magic words. Tell them not to call third-parties (relatives, friends and neighbors) either. Tell them, if you want, to only call you at home at certain hours. Just because you invite them to call at that time does not mean they have to honor it. No law says that just because the phone rings means that you have to answer.
