I just got a continuence on a court date. A collection agency is atemting to file a judement against me. I have ignored there threats for years. I was going to ignore this one also but I felt pushed to act on this one. I did some resarch on forums mostly. I don't like what I've been reading . I have been unable to pay these debts for some time now a nothing is going to change once this judgement is placed against me. I don't want a sheriff coming to my house and selling my things. I'm a solo-propritor of a handy-man service, can they sell my tools? Should I change my bussiness to a LLC, would that protect my tools and my van.Should I put all the veihicals in my wifes name would that help? Could I claim all my tools and household items are my wifes, will this help? I have two kids and my wife is preagnant, we don't need are belongs sold.

If it is a collection agency that is suing you, simply hire a consumer attorney to defend the case. Our success rate, and in fact all consumer attorney's success rate against collection agencies is pretty high. In my experience, lawsuits filed by collection agencies are legally insufficient, and often we can have them dismissed from court.

You mention that you are married. If the lawsuit is only against you, then they cannot execute on anything that you and your wife own jointly. You dont claim that the items are your wife's, but rather that you two jointly own them, of course, if that is the truth.
