Legal Question in Credit and Debt Law in Pennsylvania
Debt Collection
I recently paid a debt collection
company appx $10,000 for a
supposed debt I constantly recieved
phone calls about. I am not sure
whether I owed all of this money or
not. I was never provided with a
copy of the debt purchase so that I
could see if I purchased anything on
this ''credit card'', as I am unsure if I
had a card under the name I was
given from the debt collection
agency. Recently, I obtained a copy
of my credit report just to find that
this so called credit card and account
number were not listed on my credit
report. The collection agency never
reported it, after all debt was paid,
like they said they would. I reported
this to the Federal Trade
Commission, Better Business Bureau
and the Attorney Generals Office NY,
MD and PA. The company is located
outside of NY. I do not want to feel
forced into suing as I did in making
debt collection payments. But, what
is my other recourse in finding if the
company committed fraud in
collecting monies from me and to
obtain a statement regarding
purchase from that card and to also
get my money back from them if I
never made purchase?

Re: Debt Collection
Well, once they are paid, it is you suing them to get the money back. That's a little harder than defending a case where they are suing you. It sounds like you had some defenses to the collection itself.
However, you can file an action against them and obtain discovery the same as in any other matter. This would give you some opportunity to discover who the agency is, how they obtained the debt, what purchases were made, etc. providing the collection agency is legitimate and is still in business.
