Deceased Person's debt

My mother died last year and there is no estate. She literally died penniless. The small life insurance policy she had was used to pay for her burial. Now her creditors are hounding me for payment of credit card debt. Am I responsible?

You are not responsible unless your name is on the accounts as an owner. The estate would be responsible for the debt, but you state that there are no assets to be found. It should pretty much end there. You, as a son/daughter, would not be personally responsible for your Mother's debt.

You are not responsible unless your name was on the debt--joint account of some sort. The estate is responsible. If there is no money in the estate, tell them to stop calling.

Then, send them a letter telling them to stop calling. If they continue to call, they could be in violation of the law...and that means that you could sue THEM for money...so, if that happens, or if they get nasty and threatening, threaten to sue you, etc., contact an attorney asap.
