Legal Question in Credit and Debt Law in Pennsylvania

I don't know what to do. Please Help!

Right around December 30, 2004 I wrote out a check to a local Wal-Mart and the check was returned NSF. I forgot about it until extremely recently and had been meaning to pay it as soon as I had the money. I have been unemployed since the middle of January. I received notice in the mail today from a local MDJ about this saying that I have 10 days to respond or a warrant will be issued for my arrest. The check was for $12.94. Will this be a felony or not. I am training to go into the military and currently have a level 2 security clearance. How badly will this hurt me?

If you didnot intentionally pass a bad check you might get off. My recomendation is to get a lawyer to speak with the officer and the judge and try to get you a dissmissal with satisfaction. What that means is you pay the 12 dollars and change to walmart plus their bad check fee, you pay court costs, probably about $100 and you have the charges dismissed. I have good success with this approach. I do offer free consultations and can offer flexible payment arrangements.

Don't worry too much about it - respond to the notice and show up for your court date. Remember to bring $12.94 in cash, along with a few more bucks for court costs. Under the Rules of Criminal Procedure, if the "victim" is in agreement, the charges will be dismissed upon payment of restitution.

By the way, at $12.94 it's considered a "Summary" offense - as long as you have no priors.

Hope this was helpful! Good luck!
