Deposition for Discovery of Assets

I am in collections for a $5800 credit card bill. I am not

disputing the debt. I received a letter for Civil Court of

Phila order me to appear in the attorneys office for a

deposition for discovery of assets. What does this mean?

Do I need my own attorney? I am 6 years into a thirty year

mortgage, can I be made to sell my home. Will I be made to

sell household items to cover this debt? I have no car and

not much in savings. I have about $1600.00 in 401k.

Yes, you need an attorney right away. The deposition is where the attorney for the creditor will investigate whether and what type of assets you have to settle the debt.

You have a few alternatives all of which should be discussed with an attorney. I can't tell you if your house is or is not at risk as you haven't provided enough information.

If you are operating on a shoestring budget then you should contact your local legal aid for representation. If you have any money to pay an attorney you should hire private counsel immediately.
