Legal Question in Credit and Debt Law in Pennsylvania

dismissal without prejudice

What does this mean:

''ORDER TO DISCONTINUE WITHOUT PREJUDICE FILED BY PLAINTIFF(S) ATTORNEY''

My husband owed money for college and was never served papers. I came across two cases filed against him by the university. Both end in above. What does this mean?

Re: dismissal without prejudice

You asked about an order in an old case file.

Without seeing the actual file someone can only guess.

It would seem that the original complaining party, through their attorney asked the the matter be dismissed because they could not find the debtor. Without prejudice means that the claim may be brought again at a later time.

Student loan debt last a very long time and are difficult to avoid. You should pull you free annual credit reports (be sure to do so by mail and not online). After you get those you can better determine what you need to do to take care of old debt.
