FDCPA Court Procedures

If a debt collector violates the FDCPA can a individual sue them in a District Magistrate court / small claims court.

Does it matter if the debt collector is located in PA. or in some other state?

The action can be brought in EITHER Federal or state court, but not at the magistrate's office.

You should get an attorney who is familiar with the FDCPA. Attorney's fees are recoverable.

I suggest you obtain legal counsel. Under the Federal debt law attorney fees are recoverable. There are attorneys specializing in this area and I suggest you find one rather than do it yourself. An action should be brought in Federal Court.
