Legal Question in Credit and Debt Law in Pennsylvania
Garnishing wages
In January, a collection agency came to my home and stated that I never paid my school taxes from 2 years ago. I told the man that I never received a tax notice as I was relatively new in the area. I told him that I would have to pay it in installments a little at a time. The paper he gave me said that he would seize my property if I didn't make payments. I made a number of payments throughout the year and only had about $100. left to pay. Suddenly I receive my paycheck stub and discover that my wages are being garnished for over $400. I called the tax people who admitted that I never received a bill. I asked what happened to all the money I sent them and they said it was used for ''other taxes.'' How can they channel the payments I make to something else. Plus my company does credit profiling, and this will probably cost me my job or any chances of a future promotion. Where do I stand legally?

Re: Garnishing wages
I suggest you consult an attorney. Some of facts you describe do not seem plausible. In Pennsylvania there is no garnishment of wages for the type of claim asserted. There are requirements imposed on collection agencies both under Pennsylvania and Federal law. The procedures as described seem heavy handed, improper and possibly illegal. However, more information is needed to properly evaluate your situation. Gerald Hershenson 215-579-9390
