Harassment and the Creditor

I have a car loan and I owe for this month. It was due on the 11th. I paid last months by The first of this month. So basically I am a month not even 30 lagging in my payment.

This loan company Capitol Auto Finance is calling my job.

They start at 8 in the morning on Sat and 10:00 in the morning on a Sunday and call 30 to 45 mins apart until 5 pm.

I am ready to just tell them to come pick up this car because the harrasment is not worth it.

Please help.

First, do what Atty. McCullough said. That's the first step. If they persist, you can file an action against them.

You don't want to have them come pick up the car. The car is probably worth less than you owe on it, and you will end up still having to pay them the difference.

The Fair Debt Collection Practices Act is at http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm. See particularly section 805. Send a letter to the debt collector with your directions regarding communication so they are documented.
