Legal Question in Credit and Debt Law in Pennsylvania
Harrassing Calls About Collections Not for Us
My father-in-law has alzheimer's and is in a nursing home. The only asset he has to his name is about $3000 and a small insurance policy which we are told that both can be saved to cover some of his burial expenses.
Before going in the home credit card companies issued him credit cards which he used and can't pay. A lawyer told us that we didn't have to go through the trouble of filing for bankruptcy for him but that we may get some calls if collectors find out we are related. He never lived with us.
Collection companies are calling all throughout the day everyday asking to speak to him, there are just a few but they call several times each. Each time we tell them that no one by the name they are asking for resides at our residence and not to call back, but they still do.
My question is can we threaten them with some type of legal action for harrassment if they continue to call because the person they are looking for doesn't live with us and never has and they just keep at us? We shouldn't have to put up with this kind of harrassment.

They may be in violation of the Fair Credit Collection Act. as such, you may have a cause of action against them. If you wish, send me an email or contact me, and we can talk about what to do next.
