A creditor sent a past due account to a company presenting themselves as a ''law firm'' in Philadelphia. This ''law firm'' is listed on the BBB as a collection agency. The account is individual, so I know they can't touch my property I own with my husband. Can they access my joint bank accounts or cars with outstanding loans?

It is improper for a collection agency to represent itself as a law firm. You may be incorrect in that assumption. If true the collection agency can be penalize and you can be awarded attorney fees. Nothing can be attached unless a law suit is filed and a judgment is entered. Only accounts in your individual name are subject to attachment. That being said I suggest you consult with legal counsel to review the specific facts in your case. It is better not to have accounts in your name to avoid any problems. Gerald Hershenson Esq.
