judgement - writ of execution(money judgment)
I had a judgment on me last year. I was paying monthly through my checkings accoung on it and it wasn't enough so the debt people put it through to the bank and my savings is frozen. i called the people and tried to set up an agreement offering 1000.00(400 in the bank and 600 from a friend) one lady said no and i called again today and the guy said that after receiving the info from the bank than maybe we could try and settle or make some agreement. He gave me his direct fax to fax over the info that the bank had to fill out. This guy was nice. I am not trying to run from this but i have been on umemployment for over three months and things are hard being a single parent. what can i do and what is a writ of execution (money judgemnt) i received that in the mail today 6-19-08 does that mean the sherrifs are coming to sell all of my stuff or is that what they had to serve the bank with because it is dated 5-28-08. I don't have really anthing to sell except my car that is for work. PLease help me. Thank you and God bless.

You asked about a judgment.
You should speak with an attorney. They can more fully look at the situation and explain your options.
Generally funds from benefits are exempt from garnishments. If you are unemployed and the only funds in that account can be proven to be benefits funds then the bank must release them. Further, if unemployed then you should also consider a potential bankruptcy to rid yourself of all debts.
Further, as long as you press your rights then you can preserve a certain amount of assets. A car worth a moderate amount, some cash, and most personal items and personal property under a certain value.
You could also consider speaking with a local legal clinic or seeing if a new law school graduate could help you with your bankruptcy filing. Chances are it will provide the fresh start you need.
